We are dedicated to creating a remarkable experience and that extends to all aspects of the cruise and vacation planning process, including online through our websites and interactive features, including live online chat, applications, widgets, blogs, forms, and social media, which collectively refer to as “Services.”  This Privacy Policy outlines the data collection, use, sharing, and security measures for both online and offline data, including Personal Data (which means any information relating to an identified or identifiable natural person), by TravelPerks and its affiliates (“we” or “us”). We encourage you to review our Privacy Policy for more detailed information on specific topics. 

By providing your Personal Data or using our Services, you confirm your understanding and agreement with the terms of this Policy. The information we are collecting now will be treated consistently with this Policy, and we will provide notice to you if we change how your information is being used.

1. Personal Data Collected

Sources of Personal Data

Personal Data is collected directly from you when you book a cruise or vacation with us, visit our websites, chat with us online, sign up for our promotions, contests, sweepstakes, or webinars or access our Services through various other methods.  Most Personal Data we collect is provided to us by you directly, or by someone booking travel on your behalf.  But as set forth in greater detail below, some Personal Data is also collected automatically when you use our Services. It is your responsibility to provide us with accurate data, and to provide us with updated Personal Data when it changes.

Categories of Personal Data

The Personal Data we collect includes:

  • Identifiers (name, date of birth, gender, email address, telephone number, mobile number, address, travel preferences)
  • We use this information to contact you, book travel for you, share information that we believe may be of interest to you, and customize your experience.
  • Commercial information (credit card information)
  • We use this information to book travel for you and process payments.
  • Internet or other electronic network activity information (IP addresses, search preferences related to specific searches, your interactions with our email communications)
  • When you access websites, online chat or receive Services, and to the extent permissible under applicable law, we automatically collect some categories of data from you, including data collected using cookies, embedded scripts, and other tracking technologies (“Cookies” and “Tracking Technologies”), for website analytics, providing better security, personalizing marketing and to improve your online experience.
  • Audio information (customer service call recordings)
  • We use this information to ensure that we are providing you with adequate customer care and to improve the quality of our Services.

        Data collected when you transact with us or use our Services may include data about yourself and those traveling with you. If you purchase services for other travelers or travel companions, you must make sure that you have the right to provide their personal data to us and that those other travelers have accepted how TravelPerks uses their information as stated in this policy.

2. With Whom We Share Personal Data

We may share any of the categories of personal data as described above with service providers and business partners, as permitted under applicable laws and regulations.  This sharing may occur before, after, or during your cruise to improve Services to you.  These companies have their own privacy policies which you should refer to if you use their services.

We also may disclose Internet or other electronic network activity information about you, as well as IP address information, with third party cookie providers we use on our sites which may use this data for purposes other than strictly operational purposes. In certain jurisdictions, such sharing may be considered a “sale” of your Personal Data and you may have the right under applicable law to opt-out of or object to such sharing.  You also have the opportunity to opt out of the use of cookies that are not strictly necessary for the operation of the Services.

Under limited circumstances, your Personal Data may be disclosed to third parties as permitted by, or to comply with, applicable laws and regulations or as required by law enforcement officials; for instance, when responding to a subpoena, court order or similar legal process, to protect against fraud and unauthorized transactions, and to otherwise cooperate with law enforcement or regulatory authorities.

3. Retention of Data

We will keep your Personal Data only for as long as reasonably necessary to fulfill the purposes for which Personal Data is collected as stated herein; for as long as is necessary for the performance of the contract between you and us, if any; and to comply with legal and statutory obligations, such as in tax, trade and corporate laws. When we no longer need your Personal Data for our purposes, we will destroy, delete or erase that Personal Data or convert it into an anonymous form.

4. Security of Data

We will take reasonable steps to protect your Personal Data in our possession from loss, misuse, unauthorized access, disclosure, alteration, and destruction. For example, we use security measures including safeguarding and monitoring our network and controlling access to our files, equipment, and buildings.

You have a choice over the use of cookies as described in this Policy. If you do not wish for cookies to be used when accessing our site, please configure your specific browser settings to reject cookies. However, please keep in mind that cookies and similar technologies are an important part of how the website works; removing, rejecting, or limiting the use of cookies or other similar technologies might affect the availability and functionality of the website. 6. Marketing Communications

If you no longer wish to receive promotional marketing from us, you can opt out of our lists at any given time. To opt out of receiving our emails, please refer to the “Unsubscribe” link at the bottom of our marketing emails. 7. Your State Privacy Rights

Residents of certain states may have the following privacy rights as a matter of law.

Right to access

You may have the right to request that we disclose the categories of Personal Data collected, the categories of sources from which Personal Data is collected, the business or commercial purpose for collection, the categories of third parties with which we share Personal Data, and the specific pieces of Personal Data that we have about you.  You also may have the right to request that we provide your Personal Data to you in a readily useable format.

Right to opt out of sale/sharing

You may have the right to opt out of the sale or sharing of your Personal Data to third parties.

Right to request deletion

You may have the right to request that we delete Personal Data that we collected from you. 

Right to non-discrimination

You may have the right not to receive discriminatory treatment by us for exercise of these privacy rights. 

Authorized agent

You may have the right to designate an authorized agent to make these requests on your behalf.

We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is another appropriate security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it.
