2. TravelPerks (On & On, Inc.) - General Terms & Conditions

All TravelPerks customers agree to the full scope of these terms and conditions when doing business with us.

1. Parties: This Agreement (“Agreement”) is entered into between On & On, Inc., dba TravelPerks (“TravelPerks,” “we,” “us,” or “our”) and the participant (“Participant,” “Traveler,” or “you”) in connection with the discussion, quoting, pending or fully executed travel reservation (“Trip”) organized on your behalf. Participant acknowledges that this Trip is not operated by TravelPerks, and TravelPerks is acting solely as an agent arranging travel services on behalf of Participant.

2. Scope of Services: TravelPerks’ sole responsibility is to arrange and coordinate the specific accommodations, transportation, and excursions described in the Trip itinerary. We do not own, operate, control, or supervise any hotels, airlines, transportation companies, restaurants, sightseeing operators, guides, or other suppliers (“Supplier”, “Suppliers”) that provide services for the Trip. All such Suppliers are independent contractors whose performance is governed by their own terms and conditions. Supplier terms and conditions will also need to be accepted separately prior to the start of travel.

3. Reservation Changes: TravelPerks is not responsible for the change in any reservation detail prior to deposit, and changes in details are possible post-deposit as per the terms and conditions of the suppliers involved – this is especially true for what the Supplier has deemed as Taxes. Declined credit cards may result in canceled reservations and/or service fees. TravelPerks does not control the price of Supplier products and services. If price reductions by a Supplier are able to be passed along, TravelPerks will do so, in accordance with Supplier policies.

4. Shared Reservations and Roommate Responsibility: All reservations, regardless of the number of occupants, are created and administered as a single, indivisible booking. The first individual listed on the reservation (the “Lead Passenger”) shall be designated as the primary contact and shall bear sole responsibility for the entire reservation, including but not limited to all payments, compliance with travel requirements, and adherence to these Terms and Conditions.

While Participants may elect to share accommodations and divide costs among themselves, such arrangements are strictly private agreements between Participants. TravelPerks does not recognize or administer individual ownership interests in any portion of a reservation. The reservation is treated as a single contractual unit.

As a courtesy, TravelPerks may facilitate the collection of payments from multiple Participants within a shared reservation; however, all invoices and billing documentation will reflect the full reservation amount only. In instances where Suppliers assign different pricing to individuals within the same reservation, such pricing will be reflected exactly as provided by the Supplier. TravelPerks shall have no obligation to equalize, reconcile, or manage cost-sharing arrangements among Participants. Any agreement to divide costs equally or otherwise is solely the responsibility of the Participants.

The Lead Passenger remains fully and unconditionally responsible for the total cost of the reservation at all times, regardless of whether any other Participant fails to make payment, cancels, fails to travel, or fails to obtain required documentation (including but not limited to passports or visas). Failure of any Participant to fulfill their financial obligations shall not relieve the Lead Passenger of responsibility. If full payment is not received as required, the entire reservation may be canceled, and all applicable cancellation penalties shall apply to all Participants.

Participants acknowledge that, due to the nature of shared reservations, invoices and related documentation may include personal information of all Participants, including but not limited to full legal names, dates of birth, and travel details. Such disclosure is inherent to the administration of a single reservation and cannot be restricted. By agreeing to share accommodations, all Participants expressly consent to such disclosure.

Travel insurance, while strongly recommended, is an individual purchase decision and is issued on a per-person basis. Any travel insurance policy obtained applies solely to the individual insured and only to the specific costs attributed to that individual as reflected on the official reservation invoice. In situations where Participants elect to divide reservation costs differently from how charges are allocated by the Supplier (including equal cost-sharing arrangements), travel insurance coverage will not adjust to reflect such private arrangements. Coverage limits and eligible claims will be based strictly on the amount assigned to the insured individual on the invoice, regardless of any alternate payment arrangements made among Participants. TravelPerks bears no responsibility for discrepancies between shared payment arrangements and insurance coverage.

Changes to pricing, itineraries, travel arrangements, or Supplier-imposed requirements may affect one or more Participants within a shared reservation. Acceptance of such changes, including any resulting financial obligations, shall remain the sole responsibility of the Lead Passenger.

5. Assumption of Risk: Travel involves inherent risks, including but not limited to illness, injury, accident, theft, delay, natural disasters, civil unrest, terrorism, and travel restrictions. By purchasing the Trip, Participant voluntarily assumes all risks associated with participation, whether foreseeable or not, and agrees that TravelPerks, nor any of their respective directors, officers, employees, or agents, shall be liable for any loss, injury, damage, expense, or inconvenience arising from such risks.

6. Release of Liability: Participant hereby releases, waives, and forever discharges TravelPerks, On & On, Inc., and all of their respective employees, officers, directors, representatives, contractors, and agents (collectively, the “Released Parties”) from any and all claims, liabilities, demands, actions, or causes of action whatsoever, arising out of or related to participation in the Trip, including but not limited to Personal injury, illness, death, or property damage; Acts or omissions of any Supplier or third party; Cancellation or modification of travel plans or itinerary; Delays or loss of personal belongings; and Force majeure events beyond the reasonable control of TravelPerks. This release applies whether caused by negligence or otherwise, to the fullest extent permitted by law.

7. Indemnification: Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys’ fees) arising out of or relating to: Participant’s conduct or participation in the Trip; Any breach of this Agreement by Participant; or Any claim by a third party arising from Participant’s actions during the Trip.

8. Limitation of Liability: TravelPerks’ liability, if any, shall be limited to the total amount of payments received from the Participant for the Trip. In no event shall TravelPerks or the Released Parties be liable for indirect, consequential, incidental, special, or punitive damages of any kind.

9. Perks: TravelPerks strives to provide added “Perks” to every reservation when possible. "Cash Back" and "Ship Credit" benefits are per stateroom and are not reflected in advertised prices; actual amount will vary and is based on your vacation’s base commissionable package price, minus, but not limited to, airfare, transfers, non-commissionable costs, and adjusted to be combined with other promotions, rate codes, supplier limits, and other factors as solely determined by TravelPerks. The amount will be sent as late as 4 - 6 weeks after the end of the trip but is targeted to arrive sooner. At this time no redemption activity (completion of an online form, etc.) is required, but one may be required at any time, even after your reservation has been made. "Shore Excursion" Benefits benefit is per stateroom and is not reflected in advertised prices. Valid for all excursions booked online through our website or the official links TravelPerks provides and may require use of a discount code prior to purchase. All benefits may be reduced or eliminated due to supplier rules and policies. Additional restrictions may apply to all benefits; please contact your dedicated agent for more information.

10. Itinerary Changes and Supplier Substitutions: Participant acknowledges that TravelPerks and all Suppliers reserve the right, at their sole discretion and without prior notice, to change or substitute hotels, transportation, excursions, guides, or other Trip components if necessary for the comfort, safety, or convenience of participants, or due to circumstances beyond our control. Such changes do not constitute a material modification of the Trip and shall not entitle Participant to any refund or compensation.

11. Cancellations, Refunds, and Unused Services: All cancellations must be submitted in writing to TravelPerks. Refunds, if any, will be made in accordance with the published cancellation policy provided at the time of booking. Certain payments may be nonrefundable due to supplier requirements. No refunds will be issued for any unused portions of the Trip, including but not limited to missed meals, sightseeing, or hotel nights, regardless of the reason. Cancellation of the Trip may include both a TravelPerks fee and a Supplier fee. Participant agrees to pay all fees disclosed by their agent, whether verbally or in writing by TravelPerks, and as set out in the Supplier's terms and conditions for their Trip. TravelPerks strongly recommends the purchase of comprehensive travel insurance to protect against trip cancellation, interruption, delay, or medical emergencies.

12. Representations and Acknowledgments: Participant acknowledges and agrees that: TravelPerks acts solely as an intermediary and is not responsible for the acts or omissions of any independent Supplier. Participant has been advised to obtain comprehensive travel insurance covering cancellation, medical expenses, personal injury, and evacuation. Participation is contingent upon acceptance of all terms of this Agreement.

13. Governing Law and Venue: This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of laws principles. Any dispute shall be brought exclusively in the state or federal courts located in Lane County, Oregon.

14. Severability: If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Mandatory Acceptance of Terms and Electronic Signature: These Terms and Conditions constitute a legally binding agreement. By accessing this website, registering for any program, submitting any form, requesting services, making a payment, booking travel, participating in any activity, or otherwise using any service offered by us, the Participant expressly agrees to be legally bound by these Terms and Conditions in their entirety.

The Participant acknowledges that they have had a full and fair opportunity to review these Terms prior to engaging our services. The Participant further agrees that failure to read these Terms does not relieve them of any obligations or waive the enforceability of this Agreement.

Where a registration, booking, or payment process includes a “Yes,” “I Agree,” or similar acknowledgment, checking such box or submitting such form constitutes the Participant’s affirmative consent and electronic signature. This electronic acceptance shall be deemed the legal equivalent of a handwritten signature and is fully enforceable under applicable law, including the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act).

Acceptance of services, submission of payment, participation in any activity, or continued use of our website or services constitutes unconditional acceptance of this Agreement, whether or not a separate electronic acknowledgment is completed.

If the Participant does not agree to these Terms and Conditions, they must immediately refrain from using the website and from purchasing, booking, or participating in any services.

This Agreement is binding upon the Participant and their heirs, assigns, executors, administrators, and personal representatives to the fullest extent permitted by law.

3. Contests

Intermittently, TravelPerks Dream Vacations will be running contests related to our office, tradeshow appearances and/or social media presence. Entering ANY Dream Vacations or TravelPerks Dream Vacations Contest, Giveaway or Sweepstakes is also providing consent to be added to our communications lists and receive promotional emails accordingly. Occasionally, contests and promotions require the entrant to stay subscribed (not opt-out or turn off) these emails to remain eligible.

OFFICIAL RULES: DREAM VACATIONS CONTESTS

1. To Enter: No purchase necessary. Enter via Contest Entry Form or complete the official online registration form. Limit one entry per person unless otherwise noted. Dream Vacations, CruiseOne, Inc and World Travel Holdings are not responsible for telephone, network, electronic or computer failures of any kind, or for entries that are incomplete, garbled, delayed by mail or computer transmissions, misdirected or otherwise ineligible. All entries become the property of TravelPerks Dream Vacations and will not be acknowledged or returned. By entering a contest, entrants opt-in to receive promotional materials and/or emails from TravelPerks Dream Vacations. All Entries must be received before 11:59 pm Eastern Time on the night before the deadline.

2. Selection of Winner and Eligibility: Winner will be chosen on or soon after the Drawing Date listed in contest details in a random drawing from all eligible entries received. Winner will be notified by phone or email and announced at www.facebook.com/MyTravelPerks and on our website within 30 days of the drawing. Winner may be required to sign and return to Dream Vacations TravelPerks, an affidavit of eligibility and liability and publicity releases within 14 days of notification. A traveling companion of the Grand Prize Winner may be required to sign a liability and publicity release before ticketing. If any prize notification is undeliverable, or in the event of non-compliance with each of these requirements, the prize will be forfeited, and an alternate Winner may be selected at random from the remaining eligible entries.

3. Prize: Grand Prize is outlined in contest details for each applicable giveaway and is based on availability. The prize may not be exchanged with another ship or sail date, or exchanged in any way. Air transportation to and from the start city, non-commissionable funds, ground transfers, pre/post-hotel, taxes, fuel supplement, gratuities, shore excursions, and other personal expenditures are the responsibility solely of winner. Offer is not transferable and is not redeemable for cash or any other form of value-added compensation. No guests under the age of 21 will be booked in a stateroom unless accompanied by an adult age 25 years or older, except for married couples under the age of 21. Winner and travel companion are solely responsible for obtaining valid passports and any other documents necessary for international travel. Travel restrictions, conditions, and limitations may apply. Other restrictions may apply. Value not applicable toward any other cruise line departures. The Grand Prize is non-transferable and cannot be resold. The approximate retail value of the Grand Prize varies based on the giveaway.

4. Disclaimer: Winner assumes all liability for any damages caused or claimed to be caused by his or her participation in the Sweepstakes and/or the acceptance and/or use of any prize, and releases Dream Vacations TravelPerks Group, Dream Vacations, CruiseOne, Inc., Cruises Inc., World Travel Holdings, National Leisure Group and their respective officers, directors, and employees from any such liability. Acceptance of prize constitutes permission (except where prohibited by law) to use Winner’s name, city, state, likeness and/or voice for purposes of advertising, promotion, and publicity without additional compensation.
